1. About FEDANT and these terms

1.1 The Site is owned and operated by The Federation of Antenatal and Postnatal Educators (“FEDANT”, “we”, “us” or “our”).

1.2 These terms apply to visitors, applicants, registrants, education providers and anyone else who uses the Site. Additional terms may apply to a particular application, accreditation, registration, product, service or restricted area. If additional terms apply, they will be made available as part of the relevant process.

1.3 If additional terms conflict with these general terms, the additional terms will take priority for the relevant service.

2. Using the Site

2.1 You may use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or prevent anyone else from using it.

2.2 You must not:

• use the Site for fraudulent, unlawful, abusive or misleading purposes;
• attempt to gain unauthorised access to the Site, another person’s account, or any server, system or data connected with the Site;
• introduce malware, malicious code or any material intended to damage, disrupt or impair the Site;
• scrape, harvest or systematically extract information from the Site without our prior written permission, except where permitted by law;
• impersonate another person or organisation, or misrepresent your identity, qualifications, registration or accreditation status; or
• use information obtained through the Site to harass, discriminate against or cause harm to another person.

2.3 We may restrict, suspend or block access where we reasonably believe that these terms have been breached, the Site or another user is at risk, or action is necessary to protect the public or FEDANT’s regulatory functions.

3. Accounts and restricted areas

3.1 Some services require an account or authorised access. You are responsible for keeping your login details confidential and for activity carried out through your account.

3.2 You must provide accurate, current and complete information and promptly update it when it changes.

3.3 You must notify FEDANT promptly if you believe that your account or login details have been lost, compromised or used without permission.

3.4 Access rights are personal to the authorised user and must not be shared, transferred or used on behalf of another person unless FEDANT has agreed otherwise in writing.

4. Applications, registration, accreditation and listings

4.1 Submitting an application does not guarantee approval, admission, registration, accreditation, certification or listing.

4.2 You are responsible for ensuring that information and supporting evidence supplied to FEDANT are accurate, complete, authentic and not misleading.

4.3 FEDANT may request further information, verification or evidence before or after making a decision.

4.4 An application, registration, accreditation, approval, certification or listing may be refused, restricted, suspended, removed or rescinded where information is false, misleading or incomplete, eligibility requirements are not met, fees remain unpaid, applicable standards are not maintained, or action is otherwise permitted under the relevant rules or procedure.

4.5 A course accreditation, professional registration or other status applies only to the person, provider, course, service or product expressly identified by FEDANT. It must not be transferred, extended or represented as applying more widely.

4.6 Public registers and directories are provided to help users check the status information displayed at the time of their search. Users should check the exact name, category, course or reference number and contact FEDANT if anything is unclear.

5. Fees, payments, cancellations and refunds

5.1 Fees and charges are those published on the relevant application page, fee schedule, renewal page or invoice at the time the relevant service is requested.

5.2 Unless stated otherwise, fees must be paid in full before an application, renewal or service is processed.

5.3 Cancellation, withdrawal, administration, amendment and reinstatement charges may apply. The amount and any refund entitlement will be determined by the terms displayed or supplied for the relevant service at the time of purchase or application.

5.4 Where consumer cancellation rights apply by law, nothing in these terms limits those rights.

5.5 FEDANT may correct an obvious pricing error. If this affects a payment already made, we will explain the available options.

6. FEDANT content and intellectual property

6.1 Unless otherwise stated, the text, graphics, logos, service marks, databases, downloads, layouts and other material made available on the Site (the “Content”) are owned by FEDANT or used with the permission of the relevant rights owner.

6.2 You may view, download or print a reasonable copy of Content for your own lawful, private and non-commercial use, provided that copyright, trade mark and other proprietary notices are retained.

6.3 You must not reproduce, republish, sell, license, distribute, adapt, transmit or commercially exploit the Content without prior written permission from FEDANT or the relevant rights owner, except where permitted by law.

6.4 The names “FEDANT” and “The Federation of Antenatal and Postnatal Educators”, together with FEDANT logos and accreditation marks, are protected. They may be used only with permission and in accordance with the rules that apply to the relevant registration, accreditation, approval or certification.

6.5 Permission to use a FEDANT logo or mark ends when the relevant status expires, lapses, is suspended or is withdrawn.

7. Information and material supplied by users

7.1 You must have the right to submit any information, documents, images or other material you provide through the Site.

7.2 You remain responsible for material you submit. You must not submit anything unlawful, defamatory, discriminatory, threatening, confidential to another person without authority, or infringing another person’s intellectual property or privacy rights.

7.3 You give FEDANT permission to use, copy, store and review submitted material to administer the relevant service, carry out verification, audit or regulatory functions, handle complaints and meet legal or record-keeping obligations.

7.4 FEDANT may remove or restrict access to submitted material where reasonably necessary to enforce these terms, comply with law or protect users, the public or FEDANT.

8. Information on the Site

8.1 We take reasonable care when preparing and maintaining the Site, but Content is provided for general information and may not reflect every individual circumstance.

8.2 Content on the Site is not medical, legal, financial or other professional advice and should not be treated as a substitute for advice from a suitably qualified professional.

8.3 You are responsible for checking information relevant to a decision or commitment. Where current professional status, registration or course accreditation matters, check the applicable FEDANT register or directory and contact FEDANT if clarification is required.

8.4 We may correct, update, remove or replace Content without notice.

9. Third-party websites and services

9.1 The Site may contain links to websites or services operated by third parties. Links are provided for information and convenience and do not necessarily mean that FEDANT endorses the third party or its content, products or services.

9.2 FEDANT does not control third-party websites and is not responsible for their availability, security, privacy practices, content or transactions.

9.3 If you follow a third-party link, you do so at your own discretion and should review the terms and privacy information that apply to that service.

10. Availability and security

10.1 We aim to keep the Site available and secure, but we do not guarantee uninterrupted or error free access.

10.2 We may suspend access for maintenance, security, legal, operational or technical reasons.

10.3 You are responsible for using suitable security measures, devices, software and backups when accessing or downloading material from the Site.

11. Liability

11.1 Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

11.2 Subject to clause 11.1, FEDANT is not responsible for loss or damage that was not reasonably foreseeable, for business loss incurred by a consumer, or for loss caused by events outside our reasonable control.

11.3 Where you use the Site for business purposes, FEDANT will not be liable for loss of profit, revenue, business, contracts, opportunity, anticipated savings, goodwill or data, or for indirect or consequential loss, arising from use of or inability to use the Site.

11.4 You are responsible for loss, damage and reasonable costs suffered by FEDANT as a result of your unlawful use of the Site, material breach of these terms or infringement of another person’s rights, except to the extent caused by FEDANT.

12. Privacy and cookies

12.1 Personal information is handled in accordance with FEDANT’s Privacy Policy and applicable data protection law.

12.2 Information about cookies and similar technologies should be read together with the Site’s cookie information and consent settings.

13. Changes to the Site and these terms

13.1 We may change the Site, its Content, services or these Terms and Conditions to reflect changes in law, technology, security, FEDANT services or operational requirements.

13.2 The current version will be published on this page with a review or effective date. Changes apply from the date stated. Where a material change affects an existing paid service or ongoing relationship, we will provide notice where reasonably practicable.

14. Governing law and jurisdiction

14.1 These terms are governed by the laws of England and Wales.

14.2 If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections and bring proceedings in the courts available to you under applicable law. In all other cases, the courts of England and Wales will have exclusive jurisdiction.

15. General

15.1 If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in force.

15.2 A delay or failure by FEDANT to enforce a right does not waive that right.

15.3 These terms do not create rights enforceable by anyone other than you and FEDANT, except where applicable law provides otherwise.
